Duty
of disclosure
In the small print of every
vehicle insurance renewal you will find the following typical
wording;
'We remind you that you MUST inform us of
any changes which have occurred either since the policy commenced or
since the last renewal date. Failure to advise us of any changes may
invalidate your policy. Insurers pass information to the claims and
underwriting Exchange register. Under the conditions of your policy you
MUST tell us about any incident which may or may not give rise to a
claim'
You will then be asked if you have had any
convictions or endorsements OR made any insurance claim in the last 3
(possibly 5) years. A 'FREE' Windscreen repair and /or replacement is
still a 'claim' ~ irrespective of whether you have a 'protected'
no claim bonus and you MUST declare it otherwise the insurer can
and will refuse to indemnify you in the event of a serious accident

What the Ombudsman has to say about
'Non-disclosure' in insurance cases
"Non-disclosure" refers to the situation where a customer fails to
reveal a relevant fact when applying for – or renewing – an insurance
contract. It is widely recognised that in some situations involving
non-disclosure, applying the strict legal position can result in an
unduly harsh outcome for the customer. For this reason, when we deal
with insurance cases involving non-disclosure or "misrepresentation" –
an incorrect statement made by a customer – we take account of both the
law and good industry practice
The Legal Position
An insurance contract is a "contract of utmost good faith", which means
that all parties to the contract are under a strict duty to deal fully
and frankly with each other. Customers must disclose all facts that are
"material" (or relevant) to the risk for which they are seeking cover.
A "material" fact is one which would influence an underwriter when they
were deciding whether to accept the risk, and the terms and conditions
that should apply. If a customer fails to disclose (or misrepresents) a
material fact and this induces the insurer to accept the proposed risk,
the legal remedy is to "avoid" the policy. This means the insurer is
entitled to treat the policy as though it never existed. Unless fraud is
involved, the insurer will normally return the premium and will not pay
out on any claim made under the policy.

Drivers 'are baffled by no-claims discounts': Millions
are paying for protection in mistaken belief it will stop premiums rising

Millions of drivers are paying
for no-claims protection on their car insurance in the mistaken belief it
will stop their premiums rising, it is claimed. Motorists are forking out
extra every year to protect their no-claims discount in the event of an
accident. But many are unaware that, although this protects the discount
they have accrued from years of careful driving, their premium will still go
up.
A no-claims discount is applied
to a premium and can be worth as much as 70 per cent off the usual price.
But if a customer has an
accident, their insurance can still jump up several hundred pounds, meaning
even with the protected discount, they are pay significantly more money than
they were before.
Rod Jones, at uSwitch.com, said
many customers pay extra for protection 'without truly understanding how it
works and what it covers'.
Motorist Rick Bech was furious when his premium soared after his wife
scraped their car, despite paying for no-claims protection for four years,
and claims 'it's not worth the paper it's written on'.
He told the Independent on Sunday: 'We ended up having to make a claim and I
thought 'brilliant, no problem, we've got the protected no-claims bonus'. 'I
thought it was supposed to protect you from a hike.'
He had paid £30 extra every year for this protection policy, but when he
started shopping around for a new insurance policy a few months later, he
almost did not declare the accident, believing he did not need to.
The couple finally mentioned the accident after calling a provider to set up
a new policy, but otherwise would have risked being left without valid
cover.
He said: 'When we rang, it transpired that we
might have no-claims protection, but that it's not worth the paper it's
written on.
'They take into account that you've had an accident and are therefore a
higher risk, so my insurance rose by £30.
'I felt quite aggrieved that I was paying £30 to protect my no-claims and it
simply wasn't doing what it said on the tin.'
It is difficult to work out whether no-claims protection is worth the money.
A driver who has earned a 30 per cent discount over several years could pay
£280 on a £400 premium, for example.
But if they had an accident and their insurance premium jumped to £600, they
would pay £420 with their discount – £140 more than they were paying before. |
